摘　　要：新修订《反垄断法》加入了“鼓励创新”作为立法目标之一,在数字经济背景下,强调创新价值恰逢其时。围绕创新展开的竞争为市场带来活力,提升动态效率,并最终促进经济高质量发展。在《反垄断法》的适用中应当全面落实对于鼓励创新目标的考量,为此需对反垄断分析范式进行革新,从“以价格为中心”转向“以创新为中心”,在竞争损害理论中引入创新损害分析,将创新带来的动态效率纳入豁免或抗辩理由考量,并将其运用到垄断协议、滥用市场支配地位和经营者集中的反垄断规制中。全面落实鼓励创新目标有助于新修订《反垄断法》在数字经济时代的更好实施,并最终达到促进数字经济发展和维护创新竞争之间的良好平衡。The newly revised Antitrust Law has introduced“encouraging innovation”as one of its legislative goals,which is particularly relevant in the context of the digital economy.Emphasizing the value of innovation comes at an opportune time.Competition centered around innovation brings vitality to the market,enhances dynamic efficiency,and ultimately promotes high-quality economic development.In the application of the Antitrust Law,it is essential to fully implement considerations related to the goal of encouraging innovation.To achieve this,a paradigm shift in antitrust analysis is necessary,moving from a“price-centered”approach to one that is“innovation-centered”.This shift involves introducing innovation harm analysis within the framework of competition injury theories,incorporating considerations of dynamic efficiency resulting from innovation into the reasons for exemptions or defense,and applying these principles to antitrust regulations concerning monopolistic agreements,abuse of market dominance,and concentrations of business operators.Fully achieving the goal of encouraging innovation would contribute to the effective implementation of the newly revised Antitrust Law in the era of the digital economy,thereby ultimately achieving a balanced approach between promoting digital economic development and safeguarding innovation-driven competition.
