有关湿地的违法行为的法律责任研究——以《中华人民共和国湿地保护法》实施为重点

摘　　要：《中华人民共和国湿地保护法》的生命力和权威在于实施。从有关湿地的违法行为性质判断和规范表达角度,依据《中华人民共和国湿地保护法》,梳理出52项有关湿地的违法行为,有关湿地的违法行为的法律责任呈现出严厉惩处破坏重要湿地的行为、显著提高有关湿地的违法罚款标准、科学设定“修复+罚款”的复合责任方式等特征;为了确保《中华人民共和国湿地保护法》付诸实施,探讨了选择适用有关湿地的违法行为的法律责任的竞合规则、加强与其他生态环境资源法律的有效衔接、修改和完善省级湿地保护条例的法律责任、明确有关湿地的违法行为的法律责任的行刑衔接、依法追究湿地生态环境损害赔偿责任等多种实施路径。The vitality and authority of the Wetland Protection Law of the People's Republic of China lies in its implementation.From the perspective of judging the nature and standardized expression of illegal activities related to wetlands,based on the Wetland Protection Law of the People's Republic of China,52 illegal activities related to wetlands have been sorted out.The legal liability for illegal activities related to wetlands presents characteristics such as severe punishment for the destruction of important wetlands,significant improvement of illegal fine standards for the wetlands,and scientific establishment of a composite liability method of'restoration+fine'.In order to ensure the implementation of the Wetland Protection Law of the People's Republic of China,various implementation paths have been explored,including the selection of concurrence rules of legal liability for illegal activities related to wetlands,strengthening effective connection with other ecological environment resource laws,modifying and improving the legal liability of provincial wetland protection regulations,clarifying the connection between administrative punishment and criminal punishment for wetland violations,and investigating compensation liability for ecological Environment damage in wetlands according to law.
