中国特色档案法规标准体系现状及建设路径探析

摘　　要：中国式法治现代化是党的二十大报告对中国特色法治事业的深刻总结和科学诠释。中国特色档案法治事业的发展,需要遵循中国式法治现代化的基本理念和核心要义,推进中国特色档案法规标准体系建设。本文主要采用内容分析法,通过对代表性中国特色档案法规标准进行编码分析,发现中国特色档案法规标准建设在建设目标、代表性方案、代表性资源、主要效果等方面已经取得了一定成果,但是仍然存在档案法规标准与法治国家建设主要法规标准的衔接与融合程度不足、中国特色档案法学理论建设略显薄弱、配套制度与实施规范较为有限等不足。面向未来的中国特色档案法规标准体系建设,可以在完善中国特色档案法学理论、融入国家整体法规标准建设全局、面向国家重大公共卫生事件管控需求建立重大公共卫生事件档案管控标准、推进地方立法与配套制度建设、完善档案法的法律责任条款、加强保障性立法等方面继续发展。Chinese Modernization of the Rule of Law is the profound summary and scientific interpretation of the Communist Party of China's Twenty National Congress Report on the cause of rule of law with Chinese characteristics.The development of the legal cause of archives with Chinese characteristics needs to follow the basic idea and coremeaning of themodernization of the Chinese legal system,and promote the construction of the legal standard system of archives with Chinese characteristics.This paper mainly adopts the content analysis method,through the coding analysis of the representative archives regulations and standards with Chinese characteristics,it finds that the construction of archives regulations and standards with Chinese characteristics has achieved certain achievements in the construction objectives,representative schemes,representative resources,main effects and other aspects.However,there are still some shortcomings,such as insufficient degree of connection and integration between archives legal standards and the main legal standards for the construction of a country under the rule of law,weak theoretical construction of archives law with Chinese characteristics,and limited supporting systems and implementation norms.Building a future-oriented system of archives regulations and standards with Chinese characteristics,Further development can be made in perfecting the theory of archives law with Chinese characteristics,integrating it into the overall construction of national regulations and standards,establishing standards for the management and control of archives of major public health events to meet the needs of the management and control of major national public health events,promoting the construction oflocal legislation and supporting systems,improving the legal liabilityprovisions of the Archives Law,and strengtheninglegislation forprotection.
