摘  要:再犯危险性评估在量刑与刑事执行中的应用愈发广泛,其评估结果是刑罚决策的重要依据。我国的再犯危险性评估呈现出评估机关二元分化、评估模式多元并存的现状。不同评估模式在二元体系内交叉适用不仅限制刑罚效率,而且影响刑罚公正。基于刑罚效率与公正的考量,宜选取智能化评估作为我国再犯危险性评估的统一模式,促进司法行政资源的重新配置,实现形式公正与实质公正的统一。智能一体化评估模式的生成具有权力逻辑、实践逻辑与技术逻辑。智能评估体系的构建过程应遵循其生成逻辑,通过建构技术性正当程序规制算法权力,建立“常设+派驻”的组织形式以满足实践需求,建置全要素的评估指标体系与评估流程以发挥技术优势。The application of the risk assessment of recidivism in sentencing and execution procedures is becoming increasingly widespread,and its evaluation results are an important basis for criminal decision-making.The risk assessment of recidivism in China presents a current situation of dual differentiation of assessment agencies and coexistence of multiple assessment models.The cross application of different evaluation models within the binary system not only limits the efficiency of punishment,but also affects the fairness of punishment.Based on the consideration of penalty efficiency and justice,it is advisable to select intelligent assessment as the unified model of recidivism risk assessment in China,promote the reallocation of judicial administrative resources,and achieve the unity of formal justice and substantive justice.The generation of intelligent integrated evaluation mode has power logic,practical logic,and technical logic.The process of constructing an intelligent evaluation system should follow its generative logic,regulate algorithmic power through the construction of technical due process,establish a "permanent+stationed" organizational form to meet practical needs,and establish a comprehensive evaluation index system and evaluation process to leverage its technological advantages.
