公共领域视野下作品登记制度改革之构想

摘　　要：在版权自动取得原则下,登记非为获得版权保护的必要条件,这种无形式要件“一刀切”的版权保护模式在一定程度上造成了公共领域的限缩。作品登记制度不仅具有记录版权原始归属和版权流转变动的功能,其还具有识别作品是否进入公共领域的功能,区分作品商业价值高低及作者商业化意愿强弱的功能,对孤儿作品、人工智能生成物以及公共领域作品等特殊作品建档备案的分类管理功能等,而这些功能对于版权公共领域的保护至关重要。发现并充分发挥作品登记制度在不同情形下的功能优势,有助于保障一个广阔的公共领域空间,为人类后续创新奠定良好的制度基础。Under the principle of automatic copyright acquisition,registration is not a necessary condition for obtaining copyright protection,and this "one-size-fits-all" model of copyright protection without formal requirements has,to a certain extent,caused the restriction of the public domain and damage to public interests.The work registration system not only has the function of recording the original ownership of copyright and changes in the flow of copyright,but also has the function of identifying whether a work is in the public domain,distinguishing the commercial value of a work and the author's willingness to commercialize it,and classifying and managing special works such as orphan works,artificial intelligence-generated works and works in the public domain,etc.These functions are crucial to the protection of the public domain of copyright.Discovering and giving full play to the functional advantages of the works registration system under different circumstances will help safeguard a broad public domain space and lay a good institutional foundation for subsequent human innovation.
