摘　　要：知识产权国际争端由国家间争端解决机制向投资者—国家间争端解决机制(ISDS机制)的纵向论坛转移趋势凸显。这对于美国及其知识密集型产业为代表的强权一方而言,可以减轻知识产权争端解决的地缘政治及国际法合规风险,降低据以解决争端的国际法规则的价值位阶,提升知识产权人参与知识产权国际争端解决的主动性。面对新一轮变革,中国应从宏观上把握全球知识产权治理变革的历史趋势,从中观上发掘人类命运共同体话语深入重构知识产权国际争端解决机制变革的契机,微观上可以推动知识产权ISDS机制“适应知识产权特性”“融入可持续发展及企业社会责任理论”“尊重国家公共管理权”等的重构路径,为知识产权国际争端解决机制的重构贡献中国方案。International disputes over IPR are shifting vertically from the State-State Dispute Settlement Mechanism to the Investor-State Dispute Settlement Mechanism(ISDS).For proponents of strong IP protection,represented by the United States and its knowledge-intensive industries,this can mitigate geopolitical and international law compliance risks,allows international law at lower levels of value to apply,and can boost their economic and political position in international IP dispute settlement.In the face of this new round of reform,China should grasp the historical trend of global intellectual property governance reform from a macro perspective,explore the opportunity for the discourse of "A Community with a Shared Future for Mankind" to be deeply integrated into the reform of the international IPR dispute settlement mechanism from a middle perspective.At the micro level,China can push for the restatement or reconstruction path of IP ISDS mechanism,such as adapting it to the characteristics of intellectual property,integrating into the theories of sustainable development and corporate social responsibility,and respecting nations' police power.
