数字时代社会纠纷的结构变迁及其解决机制重构

摘　　要：随着数字时代的到来,整个社会结构及其承载的内容都发生了根本性调整,数字时代的社会纠纷从宏观角度可以类型化为传统社会纠纷、数字孪生纠纷和数字原生纠纷三种,并在纠纷类型、纠纷产生、纠纷解决及层级演变方面呈现出典型的数字化特征。面对不同类型的纠纷,应运用不同的纠纷解决思维来构建与之相匹的纠纷解决机制。具体而言,针对传统社会纠纷,应客观评估当前纠纷解决方式的数字化转型趋势,重点解决数字化转型过程中存在的信任危机问题;针对数字孪生纠纷,应正确认识其与传统社会纠纷在数字技术联结上的差异,需要按照数字技术逻辑重构纠纷解决方式;针对数字原生纠纷,应未雨绸缪,充分认识提前布局数字原生纠纷解决机制的重要性。With the advent of the digital age,the entire social structure and the content it carries have undergone fundamental adjustments.From a macro perspective,conflicts and disputes in the digital age can be classified into three types:traditional social disputes,digital twin disputes,and digital native disputes.They exhibit typical digital characteristics in terms of dispute types,dispute generation,dispute resolution,and hierarchical evolution.Based on the digital characteristics of different types of disputes,it is necessary to use different dispute resolution thinking to construct a corresponding dispute resolution mechanism.Specifically,in response to traditional social disputes,an objective evaluation of the digital transformation of current dispute resolution methods should be conducted,with a focus on addressing the trust crisis issues that exist during the digital transformation process.In response to digital twin disputes,it is necessary to have a correct understanding of the differences between them and traditional social disputes in the connection of digital technology,and to reconstruct the dispute resolution method according to the logic of digital technology.As to digital native disputes,they have begun to emerge and are gradually increasing in society,so it is necessary to take precautions and lay resolution mechanisms in advance.
