摘　　要：【目的/意义】星际文件系统(IPFS)是近年出现的备受瞩目的区块链分布式存储项目,具备良好的发展前景。但是由于规制的缺位,导致相关案件频发。因此,亟须构建起完善的规制体系。【设计/方法】通过对2018~2022年间IPFS相关案件裁判文书的实证分析,总结出IPFS相关案件的共同特征。进而针对案件特征,分析了IPFS行业未来发展可能,从政府、企业和公民的角度提出IPFS未来规制体系的构建路径。【结论/发现】IPFS相关案件存在以下特征:IPFS在中国发展存在2019年、2021年两段高峰期;IPFS相关案件案情较为简单但涉案金额较大;IPFS相关案件在特定时间段内围绕特定区域或特定当事人集中发生。研究指出不应对IPFS全盘否定或全盘肯定。从政府角度应加强重点对象监管,密切关注行业发展;从企业角度应强化合规管理意识,探索技术研发创新;从公民角度应提升风险防范意识,抵制投机炒作行为。多管齐下推动IPFS行业健康发展,助力数字经济建设。[Purpose/Significance]Inter Planetary File System(IPFS)is a high-profile blockchain distributed storage projects that has emerged in recent years,which has good prospects for development.However,due to the absence of regulation,related cases occur frequently.Therefore,it is urgent to build a perfect regulation system.[Design/Methodology]Through the empirical analysis of judgment documents related to IPFS from 2018 to 2022,the common characteristics of IPFS-related cases are summarized.Then,according to the characteristics of the case,the possibility of future development of IPFS industry is analyzed,and the construction path of future regulation system of IPFS is proposed from the perspective of government,enterprises and citizens.[Conclusions/Findings]IPFS-related cases have the following characteristics.First,there are two peak periods for IPFS development in China in 2019 and 2021.Second,IPFS-related cases are relatively simple but involve large amounts of money.Third,IPFS-related cases are concentrated around specific areas or specific parties in a specific period of time.In view of the above characteristics,the study points out that IPFS should not be rejected or affirmed outright.From the perspective of the government,it should strengthen the supervision of key targets and pay close attention to the development of the industry. From the perspective of enterprises, they should strengthenthe awareness of compliance management and explore technological research and innovation. from the perspectiveof citizens, they should enhance the awareness of risk prevention and resist speculative behaviour. A multi-prongedapproach should be taken to promote the healthy development of the IPFS industry and facilitate the construction ofdigital economy.
