“地摊经济”的宪法原理阐释及证成——以公民生存权为视角

摘　　要：突发公共卫生事件使我国公民遭遇困境,众多公民因失业而面临生存难题,此即国家保护公民生存权之缘由。“地摊经济”作为我国保民生、稳经济、促就业的一种经济形式,落入非公有制经济保护范畴,具有宪法上的正当性。“摆地摊”符合公民生存权的构成要件,通过宪法解释可以发现我国宪法中规定了生存权的具体内容,“摆地摊”落入公民生存权的保障范围。当公民生存权转化为一项具体的请求权时,便形成国家保护义务之基础。当前我国“地摊经济”存在法律断层现象,应在统一的法律指引下,先确认“地摊经济”的合法地位,再由各省根据实际情况制定“地摊经济”相关的地方性法规,最后由各地政府制定行政规范性文件予以细化,切实履行“地摊经济”的国家保护义务。Public health emergencies make our citizens encounter difficulties,and many citizens are faced with survival problems because of unemployment,which is the reason for the state to protect citizens’right to life.As an informal economic form of protecting people’s livelihood,stabilizing the economy and promoting employment in China,“stall economy”falls into the protection category of non-public economy,which has constitutional legitimacy.“Floor stall”conforms to the constituent elements of citizens’right to life.Through constitutional interpretation,it can be found that China’s Constitution stipulates the content of the right to life,and“floor stall”falls into the scope of protection of citizens’right to life.When citizens’right to life is transformed into a specific right of claim,which forms the basis of national protection obligations,there is a legal fault in China’s“stall economy”.Under the guidance of a unified law,we should first confirm the legal status of the“stall economy”,then the provinces should formulate local regulations related to the“stall economy”according to the actual situation,and finally the local governments should formulate administrative normative documents to refine it,so as to effectively fulfill the national protection obligations of the“stall economy”.
