流域生态“执法+司法”联动的法治逻辑、时空困境与优化路径——以长江流域为例

摘　　要：长江流域生态“执法+司法”联动可划归为提供建议型、共同办案型、案件移送型、联合会议型、便利诉讼型、监督引导型、辅助执行型七种类型。在生态法治思想的指引下,“执法+司法”联动需以理念性逻辑、协调性逻辑、规范性逻辑为建构基础。从时空维度展开分析,发现联动实践中存在时序偏置、空间隔断的困厄,并基于这种困厄衍生出信息共享机制窒碍、法律主体角色含混的显性倾向。为契合流域生态“执法+司法”联动的法治逻辑表达,需要塑造流域生态执法、司法的多端联动法治理念;协调联通流域生态“执法+司法”联动的区域范围,并尝试规范设置联动主体间的治理边界,力避因行政逻辑与司法逻辑混同产生的制度逻辑错位。In relation to“law enforcement and judice”linkage in the Yangtze River Basin,seven different types can be identified,including offering advice,joint case handling,case transfer,joint conference,facilitating court proceedings,supervision and guidance,and auxiliary execution.Directed by the ecological law enforcement ideology,the relationship between“law enforcement and justice”must be founded on conceptual,coordination,and normative logic.Timing bias and space partition present difficulties in the linkage practice,finding an explicit tendency of spatial-temporal misplacement and impeded information sharing mechanisms,which creates ambiguity in the roles of legal subjects.In order to conform to the logical expression of the rule of law of the linkage of“law enforcement and justice”in the river basin ecology,it is necessary to shape the multi-terminal linkage legal concept of ecological law enforcement and justice in the river basin,to coordinate and connect the regional scope of the ecological“law enforcement and justice”linkage in the river basin,and try to standardize the governance boundary between the linkage subjects,avoiding the misalignment of system logic that can be caused by the integration of administrative and judicial logic.
