摘 要:公办学校体育场地设施向公众开放收费的性质模糊不清,致使各地关于收费制度的规定不一致。应该基于行政事业性收费与经营服务性收费、行政性收费与事业性收费的区别,通过规范分析方法,将公办学校体育场地设施向公众开放收费认定为事业性收费,并据此进行相应的法律规制。法律规制措施包括:将其纳入行政事业性收费目录清单,将收费标准的审批机关确定为国务院或省级政府的价格部门,审批过程中实行成本审核制度和听取意见制度等,以保障收费的公益性和补偿性。The nature of fees for public school sports venues and facilities opening to the public is unclear,which leads to the different regulations on the fee charging system in various places.Based on the distinctions between administrative fees and operating service fees,institutional fees and non-profit-making service fees,through the method of normative analysis,the fees for public school sports venues and facilities opening to the public should be recognized as non-profit-making ser-vice fees,so the fees are regulated correspondingly.The legal regulatory measures are as follows:to make them in the cata-logue list of administrative fees,to fix the price administration departments of the State Council or provincial governments as the examination and approval organs for the fees,and to implement the system of cost audit and the system of hearing opinions in the process of examination and approval,etc.,in order to ensure the public welfare and compensation of fees.
