《档案法》司法适用的实证与法理——以647份司法裁判文书为分析样本

摘　　要：《档案法》为我国档案法治建设提供了基本规范依据,对其司法适用状况开展实证研究有助于进一步提高立法质量和实施效果。以法院647份司法裁判文书为样本进行分析,发现该法在规范档案管理和协调涉档关系等方面发挥了重要作用。但《档案法》司法适用实践也暴露出该法评价、预测、强制、教育等法功能发挥不足,立法的利益协调性和实践回应性存在缺憾,司法的程序公正与实体公正彰显不够等问题。未来宜在完善《档案法》基础上加强配套规范供给、健全法律衔接机制,在充分发挥档案司法解释、指导性案例作用基础上加强档案裁判释法说理工作,进一步完善档案立法评估机制、健全档案多元纠纷解决机制,以《档案法》的良法善治助推中国式档案事业现代化。The Archives Law provides basic norms for the construction of the archives rule of law in China,and conducting empirical research on its judicial application will help to further improve the legislative quality and implementation effect.Taking 647judicial decisions of courts as samples for analysis,it is found that the law has played an important role in regulating file management and coordinating file related relationships.However,the judicial application practice of the“Archives Law”has also revealed that the law's legal functions such as evaluation,prediction,coercion,and education are not fully utilized,there are shortcomings in the coordination of legislative interests and practical responsiveness,and there are insufficient manifestations of judicial procedural and substantive justice.In the future,it is advisable to strengthen the provision of supporting norms and improve the legal and legal linkage mechanism based on the improvement of the Archives Law,strengthen the interpretation and reasoning work of archives adjudication based on the full play of the role of judicial interpretation and guiding cases of archives,further improve the evaluation mechanism of archives legislation,improve the resolution mechanism of diversified disputes in archives,and promote the modernization of Chinese style archives undertakings with the good law and good governance of the Archives Law.
