摘 要:非现场执法在我国数十年的发展史中充分展现出了其相较现场执法的优势,而随着非现场执法引入算法等技术,亟待公法更多地介入到非现场执法的规制当中。现阶段我国交警非现场执法在其行政价值实现中仍然面临着执法创收背景下应时而生的执法乱象、上令下从的行政管理困境、算法黑箱对正当程序的冲击、非现场执法自身程序性合理性义务未尽等问题。研究认为,执法机关应从重塑政绩评价体系、促进人民监督体系与干部容错机制的结合、优化算法公开策略、改良具体执行程序四个维度对非现场执法现存弊端加以规制。Off-site law enforcement has fully demonstrated its advantages over on-site law enforcement in the decades of development history in China.With the introduction of algorithms and other technologies in off-site law enforcement,public law urgently needs to be more involved in the regulation of off-site law enforcement.The study finds that at the present stage,there still exist some problems in the realization of administrative value of traffic police off-site law enforcement in China,such as the law enforcement chaos that arises under the background of law enforcement revenue generation,the administrative management dilemma of subordinates,the impact of algorithmic black boxes on due process,and the unfulfilled obligations of procedure and reasonableness of off-site law enforcement.The study holds that law enforcement agencies should regulate the existing drawbacks of off-site law enforcement from four dimensions:reshaping the performance evaluation system,combining the public supervision system with the fault-tolerant mechanism for cadres,optimizing the algorithm disclosure strategy,and improving specific execution procedures.
