疫情下经营性房屋租赁合同中情势变更条款适用实证研究——基于237份判决书的分析

摘　　要：新冠肺炎疫情对经营性房屋租赁合同的履行造成了重大影响。选取237份相关的判决书进行实证分析,发现司法实践中存在情势变更条款适用困难、裁判依据不统一、涉案当事人举证困难等问题。提出应当明确情势变更适用要件和标准、统一裁判依据,规制法官自由裁量权、平衡合同当事人利益,注重增强当事人维权意识的建议,以期更好地发挥情势变更条款在解决疫情下经营性房屋租赁合同纠纷的作用。The COVID-19 epidemic has had a significant impact on the performance of operating housing lease contracts.This paper selected 237 relevant judgments for empirical analysis,and found that in judicial practice,there were problems such as difficulties in applying the terms of change of circumstances,inconsistent judgment ba-sis,and difficulty in producing evidence for the parties involved.This paper proposed that the requirements and standards applicable to the change of situation should be clarified,the basis for judgment should be unified,the dis-cretionary power of judges should be regulated,the interests of the parties to the contract should be balanced,and the parties awareness of rights protection should be emphasized,with a view to making better use of the change of situation clause to solve the problem of operating housing under the epidemic.
