摘　　要：在经济全球化趋势下,知识产权保护与跨国专利授权已成为我国及其他发展中国家的发展驱动力与基石。针对跨国最优专利授权策略选择及其影响问题,本文以外国企业和本国企业构成的垄断市场为研究对象,建立经济模型并求解模型均衡,分析跨国最优专利授权策略选择及其对本国企业决策、社会福利等方面的影响。研究发现:跨国最优专利授权策略包括低版税、固定版税、高版税三种情形,并从理论上证明了固定收费、双重收费等形式专利授权策略的存在性;外国企业的跨国最优专利授权策略选择可能会对本国企业不利,并导致专利授权方及被授权方利润的不平等分配,该结论解释了跨国专利纠纷发生的原因。在此基础上,提出了基于收益共享的帕累托改进策略。最后,基于理论分析框架和结果,通过案例分析给予检验并提炼相应的管理启示。本研究所得结论可为跨国专利授权实践提供理论依据和决策参考。With the globalization of the economy and the development of science and technology,intellectual property protection and transnational patent licensing have become driving forces in China and other developing countries.Patent licensing is also the key to the transformation of intellectual property into productivity and has become an important part of international trade.However,the interests of the patent licensor and the licensee in the transnational patent licensing cooperation are not consistent.However,the interests of the patent licensor and the licensee are inconsistent in transnational patent licensing cooperation,and the patent licensor is easy to obtain excess returns through unequal patent licensing agreements,which will lead to patent infringement disputes and even international trade disputes.Therefore,based on the game relationship analysis between patent licensor and licensee,the optimal patent licensing strategy selection and its impact are studied.The main innovations of this paper are as follows:Firstly,considering the asymmetry of consumer preference information between foreign firm and domestic firm,we study the choice of optimal multinational patent licensing strategy and its impact under asymmet-ric information,which is helpful to solve more practical problems and get new enlightenment.Secondly,most of the existing literature studies the selection of patent licensing strategies in established forms,and we do not restrict the forms of patent licensing strategies,and theoretically demonstrate the existence of different forms of patent licensing strategies and their selection conditions.On this basis,further from the perspective of competition and cooperation to explore the conditions for foreign firm and domestic firm to achieve Pareto improvement,which not only yields more new revelations,but also contributes to the enhancement of synergistic op-erational efficiency of multinational patent licensing cooperation.Thirdly,the relationship between royalty commission and one-time fixed licensing fe
