摘　　要：知识产权领域的“新枫桥经验”遵循减少司法干预、保障民间自治和促进纠纷内化的基本理念,积极发挥本领域专业人士在知识产权纠纷解决和创意保护与激励中的作用,寻找法院诉讼之外替代性纠纷解决路径。阿里巴巴电商知识产权保护模式、北京软协人调委模式及苏州刺绣版权交易平台等三个有代表性的实例表明:我国知识产权领域经过多年探索,在专利、商标、著作权的保护及相关创意的保护与激励方面成功开创了“新枫桥经验”,三个案例也显示出我国知识产权领域新枫桥经验“平台自治—专业市场建构—行业自治”的类型性、递进性等特征。在知识产权大保护格局的背景下,知识产权领域“新枫桥经验”对完善我国知识产权司法审判、多元纠纷解决机制、知识产权治理体系等方面有诸多深刻启示。The"Fengqiao experience"is a unique academic term in China,specifically referring to a governance model and practical experience with characteristics,historical inheritance,and continuous innovation and development.As the inheritance and innovation,the"New fengqiao experience"has more vitality,which contains many universal legal thinking,rules and methodologies,and is of unique significance for promoting the development and innovation of the rule of law in China in the new era.On the basis of clarifying the status quo,applicability and rationality of the"New fengqiao experience"in the field of intellectual property rights in order to further explore the application value of the"New fengqiao experience"in the field of intellectual property rights,and its contribution to the improvement of the intellectual property rights judicial trial,multi-dispute resolution mechanism,intellectual property public policy and governance,as well as the enlightenment of protection and innovation incentives,three representative cases are selected for empirical analysis in this paper.Research shows that the limitations of the current intellectual property judicial trial system and the insufficient incentives for innovation in the existing institutional protection model have always been one of the problems that plague the theoretical and practical circles.The basic concepts of intervention,protection of civil autonomy,and promotion of internalization of disputes of the"Fengqiao experience",actively play the role of professionals in this field in the resolution of intellectual property disputes and creative protection and incentives,and look for alternative dispute resolution paths other than court litigation.The"New fengqiao experience"in the field of intellectual property rights exploits the potential and advantages of the intellectual property system by giving full play to the active role of micro-groups and professional industry organizations,plays the role of incremental innovation,and overcomes the limitations of judicial protecti
