经济法视角下消费者权益行政保护责任研究

摘　　要：中国的消费者权益保护问题往往与消费者行政保护缺位有关,以行政保护作为消费者权益的主要保护路径,并以责任使之制度化,兼顾了经济法正义与效率的价值。但由于消费者权益保护法早期受“特别民事权利”论引导形成的理念偏差,以及消费者权益行政保护责任主体的分散性形成的制度实施和制度完善的多重困境,消费者权益行政保护长期处于法律规范供给总体不足,行政保护各部分发育不均,尤其行政援助制度发育欠佳的状态。因此,应当从经济法的视角对消费者权益行政保护责任进行重塑,明确消费者权益的人权属性,设立独立、统一且具有较高层级的消费者行政保护责任主体,并以责任规范的完善为消费者权益行政保护规范的持续供给和行政援助制度的发展提供保证。Issues about the protection of consumer rights and interests in China often involve the lack of consumer administrative protection.Administrative protection is a main path for the protection of consumer rights and interests,and to institutionalize it with responsibility takes into account the value of justice and efficiency in economic law.However,due to the ideological deviation formed by the guidance of the"special civil rights"theory in the early stage of Law of the P.R.C on the Protection of Consumer Rights and Interests,and multiple dilemmas in institutional implementation and improvement caused by decentralized subjects responsible for the administrative protection of consumer rights and interests,the administrative protection of consumer rights and interests has long been in a state of overall insufficient supply of regulations,uneven development of administrative protection sectors,especially poor development in administrative assistance system.Therefore,it is necessary to reshape the administrative protection responsibility for consumer rights and interests from the perspective of economic law,clarify the human rights atributes of consumer rights and interests,establish independent,unified and high-level responsibility subjects for consumer administrative protection,and provide a guarantee for the continuous supply of administrative protection regulations in this respect and the development of administrative assistance system through the improvement of responsibility norms.
