依产权二元结构:为资本设置“红绿灯”

摘　　要：党和国家适时提出为资本设置“红绿灯”,必须明确设置的依据、位置及其运行规则等。为资本设置“红绿灯”既是资本自由行与禁止入的结合,也是市场激励、政府管制的互补与边界。通过法律规则控制、调节资本的政府限制属于禁入的“红灯”,市场作用以及产权保护属于自由行的“绿灯”。政府限制资本是市场经济的内在要求,但现代市场经济的发展不允许普遍性限制资本。根据资本增殖的特性,“资本运行”是为资本设置“红绿灯”的位置。为此构建资本产权状态二元结构理论,资本静态归属产权的支配绝对自由,资本动态利用产权受到源自社会化的政府限制。为资本设置“红绿灯”,集中在市场壁垒的资本垄断、社会成本的外部性、劳动力资本化管理等多方面。To timely set a“raffic light”for capital,the Party and the state must clarify the basis,location,and operating rules for such a setup.The“traffic light”for capital entails a combination of allowing and prohibiting capital flows,as well as a synergy between market incentives and government regulation,defining their boundaries.Government restrictions on capital,controlled and regulated by legal rules,are considered the“red light”of prohibition,while market forces and property rights protection represent the“green light”of freedom.Restricting capital is an inherent requirement of a market economy,but the development of a modern market economy does not permit universal restrictions on capital.In light of capital's growth.characteristics,determining the“operation”of capital is the key to setting the“traffic light”.The theory of a dual structure of property rights for capital is constructed,where static ownership rights over capital are dominated by absolute freedom,while the dynamic utilization of capital is subject to government restrictions arising from socialization.The setting of a“traffie light”for capital focuses on various aspects,such as capital monopolies due to market barriers,externalities of social costs,and the capitalization of labor management.
