元宇宙治理的法治特点与边界

摘　　要：元宇宙具备专有的社会生产方式、可靠的社会关系纽带、独立的社会本体属性以及“超拟像”社会类型,本质上是社会的新型样态。领域法是疏导元宇宙越轨风险、失序风险、信用风险的良策。元宇宙中出现的法律关系、与其他元宇宙的链接、对现实社会的影响,都可通过社会连带观念进行化解。法治促进了元宇宙的社会本位,昭示了法治治理的品格。元宇宙法治运行有其边界,在承认元宇宙主体地位、赋权自治规则效力、保护元宇宙基础设施的前提下,无须过度干预元宇宙的自生自发秩序。对于元宇宙的结构性风险,法治可通过调控式、规制式、平衡式的三维路径适度介入。The metaverse is characterized by its unique mode of production,reliable bonds of social connections,and independent social entity.Field laws can help reduce metaverse’s transgression and credit risks,among other risks.The legal relationships that emerge in the metaverse,its links to other metaverses,and its impact on the real society can be governed using the concept of social connectivity.The rule of law clarifies the social role of the metaverse,but the rule of law in the governance of metaverse should have its boundary:there is no need for too much interference except for recognizing the subjectivity role of the metaverse,empowering rules for its self-governance,and protecting its infrastructure.As regards the structural risks of the metaverse,the rule of law can intervene moderately through a three-dimensional path of regulation,restriction and balancing.
