摘　　要：农村集体产权交易平台的法律性质、功能与构造是农村集体产权交易平台制度的核心内容。未来立法赋予农村集体产权交易平台以非营利性法人资格,有利于降低交易成本以及促进交易监督管理,具有一定的比较优势。以市场化为基本理念,未来立法应当将农村集体产权交易平台的功能确定为信息发布、组织交易、交易监督管理以及促进交易鉴证。农村集体产权交易平台的内部体系结构为权力机构-管理机构-职能部门,其外部体系结构为农村集体产权交易平台-分支机构-次级分支机构-复次级分支机构亦或农村集体产权交易平台-分支机构-次级分支机构。The legal nature,function and structure of rural collective property rights trading market are the core content of rural collective property rights trading market system.The future legislation gives the rural collective property rights trading market the non-profit legal person status,which is conducive to reducing the transaction cost and facilitating the transaction supervision and management and has certain comparative advantages.Taking marketization as the basic idea,the future legislation should define the functions of rural collective property rights trading market as information release,transaction organization,transaction authentication and transaction supervision and management.The internal system structure of rural collective property rights trading market is power organization,management organization and functional department,and its external system structure is rural collective property rights trading market,branch,secondary branch,multiple branch or rural collective property rights trading market,branch,secondary branch.
