意思自治视野下的集体经营性建设用地入市

摘　　要：集体经营性建设用地入市改革在多年试点后,已被2019年修改的《土地管理法》肯认,并在全国推广实施。然而,从对现有政策、法律文件的解读,农村土地现状的考察等角度出发,集体经营性建设用地入市的各环节都应该尊重农民的意愿与选择,用任意性规范引导农民的意思自治。盖因土地资源的特殊性和重要性,以及意思自治的局限性,在规范层面应该对必要事项进行明确规定。为了使集体经营性建设用地入市快速、高效地完成,还应该构建监督和救济制度,尤其应强化基层党组织的监督作用,健全集体组织内部监督机制,完善集体土地纠纷的仲裁和诉讼等救济途径,以确保集体经营性建设用地入市在全国顺利推行,惠及各方。The reform of entering the market for collectively operated construction land has been approved by the Land Management Law revised in 2019 after years of pilot projects,and has been promoted and implemented nationwide.However,from the perspectives of the interpretation of existing policies and legal documents,and the investigation of the status quo of rural land,all links of collective construction land entering the market should respect the wishes and choices of farmers,and use arbitrary norms to guide farmers'autonomy of will.Due to the particularity and importance of land resources and the disadvantage of autonomy of will,necessary matters should be clearly stipulated.In order to quickly and efficiently complete the entry of collective operating construction land into the market,a supervision and relief system should also be established.In particular,the supervision role of grassroots party organizations should be strengthened,the internal supervision mechanism of collective organizations should be improved,and the arbitration and litigation of collective land disputes should be improved.In order to ensure the smooth implementation of collectively operated construction land entering the market throughout the country,benefit everybody.
