习近平法治思想指导下典型案例实现路径研究

摘　　要：习近平法治思想中包含了一系列关于案例法治的重要论述。实践证明,案例之所以典型,政治效果是前提,社会效果是其必须考量的重要因素,不能只追求法律效果而忽略政治效果和社会效果。凸显政治效果、社会效果和法律效果融贯统一的典型案例,是诠释法治进步的核心载体。对此,人民法院应积极围绕“公正与效率”的主题,坚持能动司法理念下的“小案事不小、小案不小办”,以完善典型案例的一体化模式为抓手,形成内外统一合力,做好典型案例培树工作,确保政治效果、社会效果和法律效果的最优统一。Xi Jinping Thought on the Rule of Law contains a series of important discourses on case-based rule of law.Practice has proved that the political effect is top priority,while the social effect is an important factor that must be considered in the making of a model case.Ignoring political effect and social effect while pursuing the legal effect only is not accepted.Model cases that achieve a coherent unity of political,legal and social effects are the core carriers to interpret the progress of the rule of law.In this regard,the people’s courts should actively focus on the theme of“justice and efficiency”,adhering to“great seriousness and diligence in handling minor cases”under the concept of active justice,taking the improvement of the integrated mode of model cases as the main focus to form internal and external synergy,and effectively cultivating model cases to ensure the optimal unity of political,social and legal effects.
