整体视域下马克思唯物主义法律思想的三维阐释:方法逻辑、本质属性与价值目标

摘　　要：以纯粹的规范形式忽视或者掩盖法律的政治意志形式和经济关系本质,是误解或者曲解法律本质的惯常思维逻辑。回归经典,正本清源,整体解析马克思唯物主义法律思想的内在逻辑,对于准确科学地认识和把握新时代全面依法治国战略的重要性和习近平法治思想的科学性具有重要指导意义。马克思将法律现象置于经济关系和国家关系之中考察和揭示其产生、运行和发展的基本规律。历史唯物主义和政治经济学批判是马克思唯物主义法律思想遵循的方法逻辑。在这一方法框架下分析得出,法律受制于物质生产方式及与其相适应的生产关系,具有物质性;法律以国家为中介获得为国家的产生和发展提供合法性依据的政治形式,具有政治性;法律是居于统治地位阶级的政治经济意志的规范载体,具有意志性。“人的解放”及“人的本质复归”是共产主义法权关系的终极价值目标。Ignoring or concealing the political will of law and the nature of economic relations in a purely canonical form is the conventional thinking causing misunderstanding or distortion about the nature of law.It is of great significance to accurately and scientifically understand the importance of comprehensive lawbased governance and the scientificity of Xi Jinping Thought on the rule of law based on a holistic interpretation of the internal logic of Marx’s materialist legal thought.Marx placed legal phenomena in economic and state relations to examine and reveal the basic rules of a state’s emergence,operation and development.Historical materialism and critique of political economy are the methodological logic of Marx’s materialist legal thought.Within this methodological framework,the present paper holds that law is material as it is restricted by the mode of material production and its corresponding production relations;law is political as it takes the state as an intermediary to obtain a political form that provides a legitimate basis for the emergence and development of the state;law has its own will as a carrier of norms of the political and economic will of the ruling class.Besides,“human liberation”and“the return of human nature”are the ultimate value goals of the communist legal relationship.
