我国健康医疗数据治理的标准化路径——以美国相关法律为借鉴

摘　　要：当前,健康医疗数据已成为国家基础性战略资源。我国健康医疗数据应用市场的爆炸式增长与健康医疗数据治理的顶层设计不完善、健康医疗数据治理的流通共享程度较低、健康医疗数据治理主体的耦合性不足等矛盾凸显,顺应信息技术发展趋势,规范和推动健康医疗数据的治理迫在眉睫。文章以美国健康医疗数据治理标准化中《健康保险流通与责任法案》(Health Insurance Portability and Accountability Act,HIPPA)、《经济与临床健康信息技术法案》(Health Information Technology for Economic and Clinical Health,HITECH)与卫生信息交换标准(health level 7,HL7)为借鉴,提炼其政策法案及管理亮点,以期对推动我国健康医疗数据治理标准化有所助力。具体而言,从形式标准化、内容标准化和协同治理标准化三方面践行健康医疗数据治理的标准化路径,以“医疗健康机构决策科学化、社会治理精准化、公共服务标准化”为目标,助力国家治理体系和治理能力现代化。Healthcare data has become a primary national strategic resource.With contradictions such as the explosive growth of China’s healthcare data application market and the imperfect top⁃level design of data governance,the low degree of circulation and sharing of healthcare data governance,and the insufficient coupling of healthcare data governance subjects are prominent,it is urgent to standardize and promote the governance of healthcare data in line with the development trend of information technology.This paper takes HIPPA,HITECH and HL7 as the standardization of healthcare data governance in the United States as references to refine its policy bills and management highlights,compares differences and gaps to promote the standardization of healthcare data governance in China.Specifically,the standardized framework of healthcare data governance is practiced from three aspects:form standardization,content standardization and collaborative governance standardization,with the goal of“scientific decision⁃making of healthcare institutions,precise social governance,and standardization of public services”to help modernize the national governance system and governance capacity.
