摘　　要：野生动物资源损害赔偿责任是涉野生动物违法行为主体侵犯国家所有者权益而产生的自然资源资产损害赔偿责任,其应当独立于行政违法责任和生态环境损害赔偿责任。野生动物资源损害赔偿责任的构成要件包括侵犯国家自然资源所有者权益的行为、国家自然资源所有者权益减损或者灭失的后果,以及行为和后果之间的因果关系。对野生动物资源损害赔偿责任的救济应当通过一般民事诉讼程序进行。有权提起诉讼的主体包括代表国家行使自然资源资产所有权的国家机关及其委托的有关部门和地方人民政府。起诉条件应当限于破坏野生动物资源给国家造成重大损失的情形。同时,应由原告承担所有举证责任,不适用因果关系举证责任倒置原则;应明确将损害赔偿金收缴至国库,且不能适用替代性责任履行措施。Compensation for damage to wildlife resources is the one for damage to natural resource assets arising from the violation of the rights and interests of the state owner by the subject of the illegal act involving wildlife,and should be independent of the administrative liability and the compensation for damage to the ecology and environment.The elements of compensation for damage to wildlife resources include the act of violating the rights and interests of the owner of state-owned natural resources,the consequences of the reduction or loss of the rights and interests of the owner of state-owned natural resources,and the causal relationship between the act and the consequences.The relief for damage to wildlife resources should be carried out through general civil procedures.Subjects entitled to bring an action include state organs exercising ownership of natural resource assets on behalf of the state,the relevant departments and local people’s governments entrusted to them.The conditions for filing a lawsuit should be limited to situations in which the destruction of wildlife resources has caused significant loss to the state.The plaintiff should bear all the burden of proof,and the principle of reversal of burden of proof should not apply.Damage should be paid into the state treasury,and alternative measures for the performance should not apply.
