“生态银行”嵌入自然资源资产管理的制度化构建

摘　　要：实现自然资源资产多元价值共振与价值衍生的和谐状态,是自然资源资产管理顺应时代潮流、呼应时代命题的核心抓手。自然资源资产管理归根结底是要解决自然资源资产开发利用面临的发展保护难协调、复合效益难实现的问题。“生态银行”所具有的绿色发展衡平理念、规模效应管理方式以及市场多元化参与手段等独特品性,使其具有了嵌入自然资源资产管理的充分可能。通过探寻“生态银行”与自然资源资产管理在法理上的连结点——生态产品价值实现,在筑牢自然资源法律规范根基的前提下,从宏观、中观、微观三个层次,搭建起由国家“生态银行”实施方案为指导、生态产品价值实现、市场化生态保护补偿以及绿色金融法律规范为支撑的制度体系;进而从“生态银行”概念的法律确认、名称使用的规范统一以及相关制度的具象表达三个维度,实现“生态银行”嵌入自然资源资产管理从事理分析到制度构建的逻辑上升。It is an era demand of natural resource assets management to realize the common development of various values of natural resource assets.The ultimate goal of natural resource asset management is to solve the con-flict between development and protection in the process of natural resource assets exploitation and utilization.Meanwhile,it also addresses the difficulties of obtaining multiple benefits from natural resource assets.The unique characteristics of the“Eco-bank”make it possible to be embedded in the management of natural resource assets,such as the balanced concept of green development,the management mode of scale effect and the means of market diversification.Through exploring the connection of“Eco-bank”and natural resource assets management in legal system--ecological product value realization and strengthening the foundation of natural resources legisla-tion,the article tries to build the framework of the legal system from different angles which contains national“Eco-bank”implementation plan,ecological product value realization,market-oriented ecological compensation and green finance.At last,the article doses some researches about the“Eco-bank”concept of legal recognition,“Eco-bank”name of standardized unity and the relevant systems of concrete expression.
