摘  要:保护华侨权益的现行地方性法规,分别采用空白规范、叙明规范、混合规范的模式确定了华侨学生在国内接受高中教育的制度安排,涵括保障华侨学生在国内接受高中阶段教育权利并予以适度“优惠”、促进地方经济发展、平衡各利益群体诉求的内容。就华侨学生在国内接受高中阶段教育的需求而言,该制度安排体现了具体的公正、微妙的公正、看得见的公正。对制定全国性的华侨权益保护法律规范,现行地方性法规具有借鉴价值。为进一步优化该制度,可在平衡各种利益的基础上,采用列举式表明华侨学生接受高中教育的地点。同时,在理论上,该制度安排体现了抽象公正受到文化因素影响;在实践上,该制度安排体现了具体公正受到资源状况的支配。The current local laws and regulations to protect the rights and interests of overseas Chinese use blank norms,explicit norms and mixed norms to determine the institutional arrangements for overseas Chinese students to receive senior high school education in China,including these students'right protection and providing them with moderate preference,promoting local economic development,and balancing the demands of various interest groups.Regard the demand of overseas Chinese students receiving senior high school education in China,the system embodies concrete,subtle and visible justice.The existing local regulations can be used as a reference for the formulation of national laws and regulations on the protection of the rights and interests of overseas Chinese.In order to further optimize the system,on the basis of balancing various interests,we can use enumeration to indicate the places where overseas Chinese students receive high school education.At the same time,in theory,the system reflects that abstract justice is affected by cultural factors;In practice,it also reflects that specific justice is governed by the state of resources.
