摘　　要：《高等学校档案管理办法》是教育部、国家档案局颁行的一部调整高校档案法律关系的部门规章。文章在梳理中国裁判文书网、北大法意(司法案例)两个数据库中案例的基础上,通过分析该部门规章在司法实践中的运用情况,讨论其存在的司法适用范围有限、行政管理功能弱化、同其他规范有冲突等问题,并提出相应的完善建议。Management Methods for College Archives is a departmental regulation which regulates the legal relationship of archives in colleges issued by the Ministry of Education and the National Archives Administration.By combing the cases in China Judgements Online and Lawyee,the paper analyzes the application of the departmental regulation in judicial practice,discusses its problems such as limited scope of judicial application,weakening administrative function and conflict with other norms,and puts forward corresponding suggestions for improvement.
