澳大利亚假球行为的法律规制及对中国的启示

摘　　要：假球,即操纵体育赛事以获取经济利益的行为,对全世界体育比赛的完整性和公平性构成了重大威胁,而澳大利亚作为早早关注体育假球治理的国家,对于假球治理形成了一套完整且高效的体系,澳大利亚通过建立完备的法律法规体系、形成特殊行政监管制度、推动假球入刑、营造良好竞争氛围等措施确立了鲜明的假球行为治理模式,这对中国体育的假球治理作出了进一步启示:完善假球专项法律法规,增设第三方专业监管机构,强化刑事司法打击力度,加强诚信体育教育。Match-fixing,the manipulation of sports events for economic gain,poses a significant threat to the integri-ty and fairness of sports competitions worldwide.Australia,as a country that pays attention to match-fixing govern-ance early on,has formed a complete and efficient system for match-fixing governance.By establishing a complete legal and regulatory system,forming a special administrative supervision system,promoting match-fixing to be criminalized,creating a good competitive atmosphere,and other measures,Australia has established a distinct gov-ernance model of match-fixing behavior,which has further inspired the match-fixing governance of Chinese sports:We will improve special laws and regulations on match-fixing,set up third-party professional regulatory bodies,strengthen criminal judicial crackdown,and strengthen integrity sports education.
