图书馆著作权合理使用制度的司法认定与完善路径——基于271份裁判文书的实证分析

摘　　要：当前,我国图书馆面临着日益严峻的著作权侵权涉诉风险,如何平衡图书馆公共服务行为与著作权保护具有重要意义。文章对271份样本案件进行实证研究,从时空分布、诉讼程序、案件内容来探究我国图书馆著作权合理使用的基本状况。在实证研究的基础上,结合“三步检验法”,归纳了我国法院认定图书馆著作权合理使用的基本要素,包括图书馆的目的和性质、作品的正常使用、著作权人的合法权益。同时通过实证研究发现法院在识别著作权合理使用的认定标准、衡量图书馆的合理注意义务、准确认定侵犯信息网络传播权行为等方面存在一定问题。未来,法院应当在重构著作权合理使用制度的认定标准,适当调整图书馆的合理注意义务,明确图书馆侵犯信息网络传播权的认定标准等方面有所作为。At present,China′s libraries are facing increasingly severe risks of copyright infringement.It is of great significance to balance the public service behavior of libraries with copyright protection.This paper conducts an empirical study of 271 sample cases to explore the basic situation of the rational use of copyright in China′s libraries from the perspective of spatial and temporal distribution,litigation procedures and case contents.On the basis of empirical research,combined with the"three-step inspection method",it summarizes the basic elements of the reasonable use of copyright in libraries determined by the court,including the purpose and nature of the library,the normal use of the work,and the legitimate rights and interests of copyright owners.At the same time,through empirical research,it is found that the court has certain problems in identifying the standard of reasonable use of copyright,measuring the reasonable duty of care of the libraries,and accurately determining the infringement of the right to network dissemination of information.In the future,the court should reconstruct the recognition standards of the reasonable use system of copyright,appropriately adjust the reasonable duty of attention of the libraries,and clarify the recognition standards for the library′s infringement of the right to network dissemination of information.
