气候法学视域下大气排放财产权利构造的原理与应用

摘　　要：大气排放市场交易的实践表明,引入市场信号和激励措施给大气排放定价这一过程需要采用赋予财产权的方式。但气候法学研究无法使用传统产权理论来解释大气环境治理的市场化转向,大气排放财产权利的构造面临难点。土地资源限定利用的财产权机制及其扩展实践,在很大程度上能够为大气排放的财产权利构造提供强有力的类比,两者在法律规制的方式、目标、结构上具有高度的相似性。进一步将研究视野拓展至淡水、海洋等环境资源的利用,可以发现大气排放财产权利本身具有的特殊属性。财产权有偿与无偿分配机制具有形式特征的程序管道,能够接收基于环境价值的大气资源利用内容,从而适用于“双碳”目标下大气排放配额的市场交易。The practice of atmospheric emissions market transactions shows that the process of introducing market signals and incentives to price atmospheric emissions requires the use of property rights.However,the study of climate law cannot adopt traditional property rights theory to explain the market-oriented transformation of atmospheric environmental governance,and the construction of property rights for atmospheric emissions faces difficulties.The property rights mechanism of limited use of land resources and its extension practice can provide a strong analogy to the property rights structure of atmospheric emissions to a large extent,and the two have a high degree of similarity in the way,goal and structure of legal regulation.With further expanding the research field of vision to the utilization of environmental resources such as fresh water and oceans,we can discover the special attributes of the property rights of atmospheric emissions.The paid or free distribution mechanism of property rights is of formal characteristics of the procedural pipeline,which can receive the content of atmospheric resource utilization based on environmental values,and thereby making the market transactions applicable to atmospheric emission allowances under the"Dual Carbon"target.
