摘　　要：数据监管是数据要素价值最大化的重要保障,是数字经济监管现代化的重要创新点。数据监管需要以科学的数据产权制度、完善的数据市场体系和以人为中心的数字伦理为制度基础。数据监管的重点是个人数据隐私保护、国家数据安全和数据流通交易秩序,并形成三者之间的互动强化。有效的数据监管需要以良好的监管体制为保障,为此应科学定位政府角色、建立高效监管体制、突出企业自治并创新监管政策工具。Data supervision is an important guarantee for maximizing the value of data elements and an important inno‐vation point in the modernization of digital economy regulation.Data supervision should promote maximizing the value of data in a socially beneficial way.Data supervision needs to be based on a scientific data property rights system,a perfect data market system,and a human-centered digital ethics as the institutional foundation.The focus of data supervision is on personal data privacy protection,national data security and data transaction order.And the focus is also to form an interac‐tive reinforcement among the three.Effective data regulation requires a sound regulatory system as a guarantee,which should scientifically position the role of the government,establish an efficient regulatory system,highlight enterprise au‐tonomy,and innovate regulatory policy tools.
