“一带一路”倡议下我国海外投资保险代位权制度的检视与完善

摘　　要：当前我国在“一带一路”沿线国投资保持稳定增长,但有些东道国政治环境复杂、地缘冲突不断,投资者面临着较高的政治风险。海外投资保险制度是保护投资者利益的有力手段,其中代位权制度是海外投资保险的核心,我国尚未建立海外投资保险的国内法体系,虽已与“一带一路”沿线的绝大多数国家签订了双边投资协定,但已无法满足保护我国海外投资者利益的现实需求。在我国已成为双向投资大国的形势下,应尽快明确我国海外投资保险代位权立法模式的选择、推动海外投资保险立法,更新细化与“一带一路”沿线国双边投资协定中的代位权条款,协同国内立法与国际立法,有效构建起海外投资保险代位权制度的权利基础和法律依据,从而保护我国海外投资者利益,同时推动“一带一路”高质量发展。At present,China's investment in countries along the"Belt and Road"has maintained steady growth,but some host countries have complicated political environments and geopolitical conflicts,and investors are faced with high political risks.Overseas investment insurance system is a powerful means to protect the interests of investors,among which the subrogation system is the core of overseas investment insurance.China has not yet established a domestic legal system of overseas investment insurance.Although it has signed bilateral investment agreements with most countries along the"Belt and Road",it can no longer meet the practical needs of protecting the interests of overseas investors in China.Under the situation that China has become a major two-way investment country,it is necessary to clarify the legislative mode of subrogation for overseas investment insurance in China as soon as possible,promotes overseas investment insurance legislation,update and refine the subrogation clauses in bilateral investment agreements with countries along the"Belt and Road",coordinate domestic legislation with international legislation,and effectively build the right foundation and legal basis of the overseas investment insurance subrogation system.So as to protect the interests of China's overseas investors,while promoting the"Belt and Road"high-quality development.
