摘 要:在数字经济时代,算法技术广泛渗入互联网,在给用户带来一定程度便利的同时,由算法引发的侵害用户权益问题也时有出现。算法价格歧视使目标消费者产生错误的支付意愿,实际剥夺了消费者知情权和公平交易权,侵犯消费者合法权益,给经营者和消费者双方以及市场秩序带来严重负面影响。文章认为,有效规制算法价格歧视行为,可从个人信息保护和算法管理的角度出发,拓宽《中华人民共和国反垄断法》的主体范围,补充告知同意框架,设立算法解释权和算法审查委员会来提高算法透明度,适用举证责任倒置和扩大消费公益诉讼主体范围等,从而完善司法救济途径,实现算法价格歧视行为的有效治理。In the era of the digital economy,algorithm has been penetrated into the internet.While bringing users convenience,cases of infringement of user rights have also emerged.Algorithm price discrimination causes target consumers to have incorrect willingness to pay,which deprives consumers of their right to know and the right to fair trade,violates their legitimate rights and interests,and brings serious negative impacts to both operators and consumers as well as market order.Hence,to address this issue,it;s believed that in order to effectively regulate algorithmic price discrimination,the scope of the main body of the Anti Monopoly Law of the PRC should be broadened from the perspective of personal information protection and algorithmic management,add the provision of informed consent,establish the right to interpret algorithms and algorithmic review committee to enhance transparency,apply the inverted burden of proof,and expand the scope of consumer litigation subjects,thereby expanding judicial relief channels and ensuring the effective governance of algorithmic price discrimination.
