广州三所综合医院85例医疗损害责任纠纷案件分析

摘　　要：目的探究大型综合医院医疗纠纷案件的现状,总结医院易产生纠纷的风险点,为医院规避风险、减少医疗纠纷提供帮助,也为法官审理医疗损害责任纠纷案提供参考。方法对广州市越秀区三所大型综合医院2015—2020年共85例医疗损害责任纠纷案的判决书进行描述性分析。结果纠纷案高发的前三个科室为骨科、妇产科、急诊科;审理程序以二审审结为主;一审审结的案件纠纷平均处理时长为3.4年,二审审结案例为4.2年,90%的医疗损害鉴定意见被法院采纳;三所医院平均每年每家医院需赔偿92.5万元;法院认定的医疗过错主要以违反注意义务为主,占比73.5%。结论医疗机构要高度重视医疗损害鉴定工作;尤其加强尸体解剖告知及病历书写管理。Objective:In order to conduct empirical research on medical injury liability dispute cases,explore the current situation of medical injury liability dispute cases in large comprehensive hospitals,summarize the risk points prone to disputes in hospitals,provide assistance for hospitals to avoid risks and reduce medical disputes,and also provide reference for judges to hear medical injury liability dispute cases.Method:A descriptive analysis was conducted on the judgments of 85 medical injury liability dispute cases in three large comprehensive hospitals in Yuexiu District,Guangzhou from 2015 to 2020.Result:The top three departments with high incidence of disputes are orthopedics,obstetrics and gynecology,and emergency department.The trial procedure is mainly the conclusion of the second instance.The average processing time for disputes in first instance cases is 3.4 years,while in second instance cases it is 4.2 years.90%of medical injury appraisal opinions are adopted by the court;the average annual compensation for each of the three hospitals is 925,000 yuan;The main medical fault recognized by the court is breach of duty of care,accounting for 73.5%.Conclusion:Medical institutions should attach great importance to the identification of medical damage;In particular,the management of autopsy notification and medical record writing should be strengthened.
