摘　　要：保护地理标志是建设知识产权强国的重要内容,也是促进区域特色经济高质量发展的重要举措。我国地理标志存在多种保护模式,在地理标志专门立法时机尚未成熟之前,以商标法作为地理标志保护主导法律具有现实必要性。当前,景德镇陶瓷地理标志保护存在地理标志监管保护冲突和地理标志商标正当使用认定标准不一问题。明确景德镇陶瓷地理标志监管保护职责,统一司法裁判地理标志商标正当使用认定标准,以构建景德镇陶瓷地理标志法律保护体系,提升景德镇陶瓷地理标志保护水平。Protection and development of geographical indications(GI)is an important aspect of making our country an intellectual property rights powerhouse and also a measure to promote the high-quality development of regional economy.However,there are many different protection modes for GI in our country.So before the ripe time comes for legislating specially for the protection of GI,it is necessary to take the trademark law as the leading regulation to protect GI.Presently,there exist some problems concerning the protection of the GI in Jingdezhen,such as the conflict of GI supervision and GI protection and the different recognition standards for the fair use of GI in trademarks.Therefore,to build a legal protection system for Jingdezhen ceramic GI and strengthen the protection of it,it is required to clarify the supervisory duties and protection responsibilities relating to Jingdezhen ceramic GI and unify the standards for determining the legitimate use of GI in trademarks.
