《消除对妇女一切形式歧视公约》的履行:聚焦非政府组织的作用

摘　　要：自1981年《消除对妇女一切形式歧视公约》生效迄今已42年,其间该公约的履行机制发生了很大变化。非政府组织在履行该公约的各个环节中发挥着越来越重要的作用。非政府组织可以在定期循环进行的审议(建设性对话)的整个过程发挥作用;中国内地向消歧委员会递交影子报告的态度经历了从最初的不了解或不支持,到现在的接受或支持的与时俱进的变化过程。从笔者本人2006年和2014年两次亲历审议现场的经历和同事们对她们参与2023年建设性对话的描述发现,中国内地非政府组织不仅参与了建设性对话,而且还就问题单组织或参与了与政府机构的讨论;在结论性意见公布后,及时组织并参与了针对结论性意见的研讨会;2023年,各方面都发生了很大变化,有进步也有问题,但是唯独不变的是人权政治化在建设性对话过程以及结论性意见中的体现。笔者就相关问题谈了自己的思考和建议。It has been 42 years since the Convention on the Elimination of All Forms of Discrimination against Women came into force in 1981.During those years,great changes have taken place in the implementing mechanisms of the Convention.NGOs have been playing more and more important roles in every segment of CEDAW implementation.NGOs may play roles in the whole reviewing process(the constitutive dialogue).The shadow reports submitted by China to CEDAW Committee witnessed a process from misunderstanding or non-supporting at first to the present acceptance or support.The author discovered,both from her own twice observations of the site scenes of the review(2006 and 2014)and descriptions of her colleagues from their own experience of the on-site review of 2023,that the NGOs from Chinese mainland have not only participated the constitutive dialogues but also organized or participated seminars on the list of questions.Seminars were timely organized and participated in 2006 and in 2023,when the concluding recommendations were issued.In 2023,great changes had taken place in every aspect,with both progress and problems,but the only thing that has not changed is the reflection of politicization in both the review and concluding recommendations.The author bring about her relevant reflections and suggestions.
