摘 要:按照联合国《消除对妇女一切形式歧视公约》履约机制的规定,进入21世纪后,联合国消除对妇女歧视委员会分别于2006年、2014年和2023年对中国的履约报告进行了三次审议,每次审议都对中国法律中没有依据公约第一条对妇女歧视作出定义备感关切,并屡屡提出相应的建议。在简要回顾三次审议的实况并对此进行粗浅分析的基础上提出改进建议:履行政府妇女事业主管部门职责,将界定“歧视定义”的工作纳入妇儿工委工作议程;加强法治建设,落实国家“消除对妇女一切形式歧视”的法律义务;大力倡导和宣传公约,提高全民族的人权意识和人权保障水平;特别在妇女组织和妇女工作者中普及妇女人权意识和性别平等理念。In accordance with the implementation mechanism for the Convention on the Elimination of All Forms of Discrimination against Women,the UN Committee on the CEDAW reviewed China’s implementation reports in 2006,2014 and 2023 respectively since the 21st century.Each review expressed great concern that Chinese law does not provide a definition of discrimination against women in line with Article 1 of the Convention,and made repeated recommendations in this regard.Based on a brief review of the three reviews on the“definition of discrimination”and a preliminary analysis,this paper puts forward further recommendations:the government department in charge of women’s affairs should fulfill its responsibilities and incorporate defining“discrimination”into the work plan of the CEDAW;strengthen rule of law and implement the country’s legal obligations to“eliminate all forms of discrimination against women”;vigorously advocate for and raise awareness of the Convention on the CEDAW to enhance human rights awareness and protection across the nation;and especially promote awareness of women’s human rights and gender equality concepts among women’s organizations and women workers.
