摘 要:闲置宅基地、废弃公益用地与集体经营性建设用地之间的地类转换是集体建设用地协同改革的关键问题。现行法尚未建立地类转换的规则,一体管制、刚性规划已经成为地类转换的桎梏。实质法治观、比例原则、集体土地的权力观为许可集体建设用地地类转换奠定了法理基础。国有建设用地差异性管制和城乡统一建设用地市场的改革探索为地类转换提供了制度基础。未来国土空间规划立法应构建集体建设用地地类转换的实体规范和程序规范。The land class conversion between idle housing land,abandoned public land and collective commercial construction land is the key issue of cooperative collective construction land system reform.The current law has not established the system rules of land conversion,and the integrated control of land use and the rigid land planning have become an institutional obstacle to land conversion.Substantive jurisprudence,proportionality principle and collective property rights provide legal support for the land class conversion of licensed collective construction land.The differential control mechanism of construction land and the institutional trend of building a unified urban and rural construction land market had provided realistic conditions for land class conversion.Therefore,the future legislation in the field of territorial space planning should establish the entity and procedure norms of collective construction land type conversion.
