检察机关民事支持起诉的实践考察及优化进路

摘　　要：支持起诉是《民事诉讼法》的一项基本原则,对维护弱势群体的民事诉权具有积极效应。检察机关作为我国宪法确立的法律监督机关,遵循处分、谦抑和补充性原则,在尊重民事诉讼规律的前提下,通过积极探索和有益尝试,为支持起诉制度的发展提供了有力保障。然而,因法律规定不够系统、明确,实践中仍面临许多现实困境和制约因素,主要表现为支持起诉法律规定不完善、介入方式不规范、参与诉讼机制不健全等方面。在现有立法基础上,参照最高人民检察院发布的第三十一批指导性案例,遵循《民事检察部门支持起诉工作指引》指导意见,检察机关需要在进一步明确支持起诉规则机制、强化内外协同履职、积极拓展工作领域、提升支持起诉办案质效等方面进行路径优化。Civil supporting prosecution is a basic principle of the Civil Procedure Law,which has a positive effect on safeguarding the civil litigation rights of vulnerable groups.As the legal supervision organs established by the Constitution of our country,the procuratorial organs follow the principles of punishment,modesty and equal rights of action,and on the premise of respecting the law of civil litigation,provide a strong guarantee for the development of the system through active exploration and beneficial attempts.However,due to the lack of systematic and clear legal provisions,there are still many practical dilemmas and constraints in practice,which are mainly manifested in the unclear role of the procuratorial organs,the lack of standardized support for prosecution,and the lack of sound mechanism for participation in litigation rules.On the basis of the existing legislation,taking the thirty-first batch of guiding cases issued by the Supreme Court of Public Prosecution as a reference,and following the guidance of the Guidelines for the Civil Prosecution Department to Support Prosecution Work,the procuratorial organs need to optimize their path in strengthening the internal and external coordination in performing their duties,actively expanding their work areas,and deepening the effect of supporting prosecution and case handling.
