摘　　要：农村“空心房”治理是乡村振兴的先手棋,对盘活闲置土地资源、改善人居环境具有重要意义。然而,在治理过程中存在着对“空心房”范围认定不一、“空心房”整治主体权责分散的问题,导致整治主体自由裁量权过大、相互推诿。因此,要明确“空心房”权利空心与实体空心两个层面的概念,从而厘清“空心房”整治的范围、明确村民委员会的治理责任主体地位、类型化科学制定“空心房”治理方案,确保农村“空心房”治理依法依规、权责分明、科学合理。The governance of“hollow houses”in rural areas is the first step in rural revitalization,which is of great significance to revitalize idle land resources and improve living environment.However,in the process of governance,there are problems of different recognition of the scope of“hollow houses”and scattered rights and responsibilities of the main body of“hollow houses”renovation,which lead to excessive discretionary power of the main body and mutual prevarication.Therefore,it is necessary to clarify the concept of“hollow houses”at the two levels of“hollow right”and“hollow entity”,so as to clarify the scope of“hollow houses”governance,clarify the main position of villagers'committees in governance responsibility,and formulate a“hollow houses”governance plan in a typed and scientific way,so as to ensure that the governance of rural“hollow houses”is in accordance with the law,with clear rights and responsibilities,and is scientific and reasonable.
