同人小说与原作著作权的冲突与协调探究

摘　　要：同人小说在满足独创性与利用性两个要件后属于演绎作品,但同人小说与原作在保护作品完整权和演绎权方面存在权利冲突,建议采取明确演绎作品的内涵与外延、分阶段保护演绎权、以法定许可限制演绎权的方式来协调解决。The fan fiction can be defined as deductive work when satisfying the two conditions of originality and application.There is a conflict of rights between fan fiction and original work to protect the integrity of the work and the right of deduction.It is suggested to coordinate and resolve the conflict of rights by clarifying the connotation and extension of the deductive work,protecting the right of deduction in stages,and restricting the right of deduction by statutory license.
