摘　　要：新中国成立以来,保障妇女权益的法律体系不断完善。2022年新修订的《中华人民共和国妇女权益保障法》为新时代生育等女性权益提供了更坚实的法律制度保障。研究发现,该法之于生育保护具有重要的理念、理论与现实意义,将性别平等贯穿于公共领域和私人领域的各方面,有助于消除对女性一切形式的歧视;面向广大女性的民生需求,有助于以性别平等助力适度生育水平与人口总量充裕;注重与其他公共制度相协调,有助于构建生育友好型社会。新法彰显了女性享有的“四大权益”、在劳动就业方面的“三重保障”以及生育保护的“双全原则”。有效贯彻落实新法,必须认识生育的本体意义,肯定生育的现实价值;加强生育保护,建设生育友好型社会;注重劳动保护,同步推进劳动保护与生育保护;重视新法的实施过程,更好地体现全生命周期性和人群之间的公平性。Since the founding of the People's Republic of China,the legal system of safeguarding women's rights and interests has been improving.Newly amended in 2022,the Law of the People's Republic of China on the Protection of the Rights and Interests of Women provides more solid legal system protection for reproductive rights and other women's rights and interests in the new era.Studies have found that by integrating gender equality in all aspects of public and private spheres,this law has crucial conceptual,theoretical and practical significance for maternity protection and helps eliminate all forms of discrimination against women;by facing the people's livelihood needs of women,helps promote appropriate reproduction levels and a sufficient population size through gender equality;and by focusing on the coordination with other public systems,it helps build a reproduction-friendly society.The new law highlights the"four major rights and interests"that women enjoy,the"triple guarantees"in labor and employment,and the"double-comprehensive principles"of maternity protection.To effectively implement the new law,we must understand the ontological significance of reproduction and affirm its practical value;strengthen maternity protection and build a reproduction-friendly society;pay attention to labor protection and simultaneously promote labor protection and maternity protection;pay attention to the implementation process of the new law to better reflect the overall life cycle and fairness among populations.
