地区司法水平与产业结构升级——来自巡回法庭设立的证据

摘　　要：产业结构升级在新发展阶段的战略重要性日益凸显,提升司法水平对推动产业结构升级至关重要。本文在构建地区司法水平与产业结构升级关系的理论模型基础上,借助最高人民法院设立巡回法庭这一准自然实验,实证检验了地区司法水平提升对产业结构升级的影响。研究发现,巡回法庭的设立显著推动了产业结构升级,体现为巡回区内高技术复杂度产业得到了相对更快的发展。机制检验表明,巡回法庭通过提升地方司法系统审判能力以及减少地方行政对司法的干预来推动产业结构升级。微观渠道检验表明,巡回法庭设立显著促进了巡回区内高技术复杂度企业投资规模的扩大及全要素生产率的提升,由此实现对产业发展的促进效果。进一步分析发现,巡回法庭设立对产业结构升级的推动效果在初始法制环境较差的省份更加显著,但在设立地址所在省份和巡回区内其他省份之间没有明显差异。本文结果表明地区司法水平的提升能够有效推动产业结构升级,为进一步推进司法体制改革、健全完善巡回法庭制度提供了证据支持。The promotion of manufacturing industrial structure upgrading is a crucial contemporary issue amidst moving faster to boost China's strength in manufacturing.The upgrading of the manufacturing industrial structure can be transformed into the relative development of industries with high/low technical complexity,as the manufacturing industrial structure upgrading can be portrayed as the evolution from low technical complexity to high technical complexity.Therefore,studying the determinants of relative development of these two types of industries can answer the question of how to advance the manufacturing industrial structure upgrading.Research in the field of international trade suggests that the institutional environment that can reinforce contract enforcement is of significance in shaping a country's comparative advantages in highly technically complex industries,indicating that the institutional environment is likely to be a significant determinant of the development of highly technically complex industries and the industrial structure upgrading.However,little research systematically examines the impact of the institutional environment on industrial structure upgrading at the level of a nation's economy.To fill this gap,this paper takes the establishment of circuit courts,a reform measure aimed at improving regional judicial quality,as an exogenous shock,and examines the impact of the judicial quality,a dimension of the institutional environment,on the industrial structure upgrading,by testing the impact of circuit courts on the development of highly technically complex industries.We construct a mathematical model based on Acemoglu et al.(2007)on the relationship between judicial quality,contract enforcement,and technical complexity adoption of enterprises.Then we propose a testable proposition that the establishment of circuit courts promotes industrial structure upgrading,evidenced by the relatively rapid development of highly technically complex industries.Empirically,we use data at the province-industry-year
