网络赌博犯罪的罪名体系与法律适用

摘　　要：随着一系列司法解释的出台和《刑法修正案(十一)》的立法修订,我国网络赌博犯罪的罪名体系日益完备,但与此同时其罪名关系和法律适用也越发复杂。赌博罪和开设赌场罪构成一般法条和特别法条的法条竞合关系,网络语境下两罪的界分不仅应强调赌场概念的高度组织性和对外开放性,而且应注重开设行为的经营性特征。赌博罪和组织参与国(境)外赌博罪同样构成一般法条和特别法条的法条竞合关系,对仅仅组织在线参与国(境)外赌博的行为,出于法律适用明确性和罪刑均衡的考虑,原则上仍按照赌博罪论处较为妥当。开设赌场罪和组织参与国(境)外赌博罪存在行为性质上的差异,但当行为人通过组织参与国(境)外赌博行为的方式来经营赌场时,仍可构成开设赌场罪和组织参与国(境)外赌博罪的法条竞合,开设赌场罪作为特别法条应优先适用。With the introduction of a series of judicial interpretations and legislative changes from the Criminal Law Amendment(XI),the criminal law norm system for online gambling crimes in China is becoming more and more complete,but at the same time its crime relationships and legal application are becoming more and more complicated.The relationship between the crime of gambling and the crime of opening casino is concurrence of ordinary article and special article.For the distinction between the two crimes in the context of Internet,not only the highly organized nature and openness of the casino should be emphasized,but also the professional characteristics of the behavior should be focused.The relationship between the crime of gambling and the crime of organizing participation in cross-border gambling is also concurrence of ordinary article and special article.In consideration of the clarity of law application and the balance of crime and punishment,the act of organizing others to participate in cross-border gambling on the Internet,is still in principle more appropriate to be punished according to the crime of gambling.There are differences in the nature of conduct between the crime of opening casino and the crime of organizing participation in cross-border gambling.However,when the perpetrator operates a casino by organizing others to participate in cross-border gambling,there may still be a concurrence of articles between the crime of opening casino and the crime of organizing participation in cross-border gambling,and the crime of opening casino should be applied as special article.
