基于国家安全视域的数据出境监管对策研究

摘　　要：数字化时代,数据已成为一种重要资源。数据的流动尤其是数据出境可能会对个人安全、社会公共安全乃至国家安全造成重大影响,因此需要对数据出境进行科学合理有效地监管。文章在分析数据出境典型安全事件的基础上,指出了当前我国数据出境监管实践中存在的若干问题。参考国外相关做法,结合我国国情,提出了健全数据安全监管相关法律法规制度体系、制定并完善数据分级分类统一标准、构建顺畅高效的数据出境监管体制机制、做好数据安全监管专门人才培养和队伍建设、创新数据出境监管技术手段、加强数据安全的宣传教育与督查等对策建议,在保障数字经济快速发展的同时确保国家安全。In the digital age,data has become an important resource.The flow of data,especially data leaving the country,may have a significant impact on personal safety,social and public safety,and even national security,so it is necessary to carry out scientific,reasonable and effective supervision of data exit.Based on the analysis of typical security events of data exit,this paper points out some problems existing in the practice of data exit supervision in China.And referring to relevant foreign practices and combining China's national conditions,several countermeasures are suggested such as putting forward a sound system of data security related laws and regulations,building a smooth and efficient data exit supervision system and mechanism,formulating and perfecting the data classification standard,innovating the technical means of data exit supervision,doing a good job of training professionals in data security supervision,improving the propaganda and education and supervision of the security on data exit and etc.,to ensure national security while ensuring the rapid development of the digital economy.
