摘　　要：医疗行为的正当化根据作为医疗刑法研究的起点,是当前刑法教义学研究的重要课题。医疗行为伤害说是医疗行为性质认定的基本立场,医疗行为正当化根据的理论探讨得以展开。以医疗行为为中心的学说过于注重行为的社会价值,忽略了患者个人价值的实现。在刑法自由保障机能之下,医疗行为正当化根据探析应以患者为中心展开。在尊重患者自我决定权的基础上,对患者同意说作谦抑性设定,维持医生开展医疗活动与尊重患者自我决定之间的动态平衡,有助于保障医疗安全和缓解医疗纠纷。在三阶层犯罪论体系下适用患者同意说,可以顺应医疗刑法的论述架构,合理判定专断医疗行为的刑法容许程度,有助于最大限度地实现医疗刑法之公平正义。The justification basis of medical acts as the Starting Point of Medical Criminal Law Research is an Important Topic in Current Jurisprudential Studies.The Harm Principle of Medical Acts serves as the fundamental standpoint for determining the nature of medical acts,providing a basis for theoretical exploration of their justification.The doctrine centered around medical acts tends to emphasize the social value of the actions,often overlooking the realization of individual values for patients.Under the framework of safeguarding legal freedom,the exploration of the justification basis for medical acts should prioritize the patient' s perspective.Respecting the patient's right to self-determination,considering patient consent as a modest constraint,and maintaining a dynamic balance between doctors' medical activities and respecting patients' decisions can help ensure medical safety and alleviate medical disputes.Applying the concept of patient consent within the three-tiered crime theory system aligns with the discourse framework of medical criminal law,allowing for a reasonable determination of the degree of legal tolerance for arbitrary medical acts.This approach facilitates the maximization of fairness and justice within medical criminal law.
