申不害“术治”思想的考察与借鉴

摘　　要：申不害是中国古代战国初期韩国著名的政治家、改革家,在韩昭侯时期担任韩国相邦,他利用谋略技巧,为韩昭侯提供了一系列以“术”为核心的统驭手段,使韩国在其治理之下国力蒸蒸日上,从一个积贫积弱、任人欺凌的弱小国家一跃成为战国初期不可忽视的中原强国,秦、魏为之侧目,并终申不害治理之世,未尝侵犯过韩国,由此可见,申不害对韩国的强盛功莫大焉,申不害的治国理政思想和谋略在后世有《申子》一书传世,对后世产生了巨大影响。申不害的“术治”思想内容具有专断性、诡辩性以及强烈的民本主义色彩,文章试图对申子的“术治”思想进行深入剖析,以为当今时代的政府及社会层面的制度设计提供有益的借鉴。Shen Buhai,a famous politician and reformer of Han in the early Warring States Period in ancient China,served as the prime minister of Han during the period of Han Zhaohou.He provided Han Zhaohou with a series of strategic control means with“Shu”as its core.Under the governance,Han had been developing significantly,from a poor and weak country that was bullied by others,becoming into a powerful country in the Central Plains that could not be ignored in the early Warring States Period.Even Qin and Wei were shocked by Han,and never invaded Han during Shen Buhai s service period.So Shen Buhai contributed a lot to Han s prosperity.Shen Buhai s governance thoughts and strategies were recorded in Shenzi,a book,greatly influencing the later generations.Shen Buhai s thoughts on Shu governance are arbitrary,sophistic and strongly people oriented.This research deeply analyzed Shen Buhai s thoughts on Shu,providing useful reference for the institutional design of the government and society in today s era.
