流氓软件侵权行为法律规制探讨

摘　　要：随着互联网的快速发展,日益增加的流氓软件给用户带来了极大的困扰。这些恶意软件利用各种手段侵入用户设备,以非法获取个人信息、散布广告、破坏设备功能等方式,给用户的个人隐私和正常使用体验带来了严重威胁。用户不仅需要担心个人信息泄露和设备受损,还频繁遭受流氓软件的广告骚扰和恶意链接的诱导,严重干扰了正常的工作和生活秩序。文章针对流氓软件侵权提出惩罚措施和对受害者赔偿的建议,并进一步探讨现有法律法规及监管机制对流氓软件侵权行为的规制。With the rapid development of the Internet,the increasing rogue software has brought great trouble to users.These malicious software use various means to invade user devices,illegally obtain personal information,disseminate advertisements,destroy device functions and other ways,which poses a serious threat to user privacy and normal use experience.Users not only need to worry about personal information leakage and equipment damage,but also frequently suffer from advertising harassment and malicious links induced by rogue software,seriously interfering with the normal order of work and life.This paper puts forward the compensation and punishment measures for the victims of rogue software infringement,and further discusses the existing laws and regulations and regulatory mechanisms for the regulation of rogue software infringement.
