摘 要:老旧小区加装电梯是近年来重点实施的民生工程,受到社会大众的广泛关注,但在实际增设电梯过程中,多数同意加装电梯的业主与少数反对加装业主之间的利益不平衡,成为加装电梯工程无法回避的事实。因此,需要立足于少数业主利益保护,从建筑物区分所有权的专有权、共有权、成员权以及相邻关系的视角深入探讨分析加装电梯法律问题,并采取利害关系人同意的表决规则,明晰业主撤销权的内容,建立完善的补偿机制,以实现高低层业主之间的利益平衡。The installation of elevators in old residential areas is a very important livelihood project in recent years,which has attracted wide attention of the public,but in the actual process,the imbalance of interests between most owners who agree to install and a few owners who oppose has become an unavoidable fact.Therefore,it is necessary to base on the protection of the interests of minority owners,from the exclusive right of condominium ownership,co-ownership,member rights and the perspective of adjacent relations to analyze the legal issues of installing elevators,and through the adoption of the voting mechanism agreed by stakeholders,to detail the content of owners’right of revocation,and to establish a sound compensation mechanism to achieve the balance of interests between high and low owners.
